- Introduction Welcome to FlygMedPoäng. These Terms of Service ("Terms") govern your use of our courses ("Platform"), website (www.flygmedpoang.se), and any services we provide through them. By using our Platform or website, you agree to the terms of this Agreement.
- Eligibility Our Platform and services are only available to individuals who are at least 18 years old and who can form legally binding contracts under applicable law. By setting up a user account on our Platform, you confirm that you are at least 18 years old and that you are allowed to legally binding contract.
- Acceptance of Conditions 3.1 In order to use the Service, you must acknowledge, comprehend and approve of the Conditions. Through the use of the Service, you are obliged to conform to the Conditions and be legally obliged to comply with them in regards to us, our representatives, and employees. Moreover, you must ensure to meticulously examine any forthcoming alterations or amendments to the Conditions and avoid using the Service unless you have fully grasped and accepted such revisions or amendments. We recommend that you read through the Conditions attentively before generating an account or using the Service in any other way.
3.2 Our Platform provides a digital chat service to assist you with the booking of flight tickets and online courses to learn how to collect more flight miles with airlines partnership and credit cards. We cannot be held responsible for scheduling changes, canceled flights, lost luggage, wrong information or other events associated with the actual flight, trip and online courses. The customer agrees to pay us for the service, the flight ticket(s), including any and all taxes and fees associated with the booking of the flight ticket(s), and any other services as may have been requested and provided to the customer. The Service's objective is to offer a digital chat to aid you in booking flight tickets.
4. Payment and Refunds 4.1 Upon selection of a specific flight or service, we will initiate the booking on your behalf.
4.2 Our Service is subject to a service fee as specified in our price list, which will be charged to your chosen payment method. Unless otherwise explicitly stated, these fees are non-refundable in case of flight cancellation.
4.3 You agree to pay for the Service, flight ticket(s), associated taxes and fees, and any additional services requested and provided to you.
4.4 Your payments will be processed by our third-party providers, currently Paypal and Stripe. For further details, please visit https://www.paypal.com/ or https://stripe.com.
4.5 You are solely responsible for any taxes or fees incurred through the use of the Service.
4.6 In the event of a transaction in a foreign currency, we will convert it to NOK based on interbank rates from customary industry sources on the business day of processing, which may differ from current rates. A transaction fee of 3% will be applied to foreign currency transactions.
4.7 All cancellations or changes to your trip must be made through FlygMedpoäng and not with the airline directly. Refunds for your trip will be issued to FlygMedpoäng, from which you may claim a refund. Written refund claims must be submitted to Flygratis within two (2) years of the initial booking.
4.8 "Purchasers of our course material have access to the material for 30 days from the date of purchase. After this period, access will expire automatically.
5. Your Responsibilities
5.1 It is your responsibility to ensure that all information you provide during registration and throughout the use of the Service is accurate, up-to-date, and complete. You are solely responsible for all information communicated or transmitted by you through the Service concerning us.
5.2 When using the Service, you must verify that all information you provide to us, such as dates, times, routes, destinations, and passenger details are true and correct. All first names and surnames must be in the order they appear on the passport, and the spelling must be identical.
5.3 You are solely responsible for managing your trip concerning us, including holding valid travel documents, passports, visas, and any other required documents. You are responsible for verifying actual and relevant flight information, such as terminal and gate information, check-in and luggage rules, and other flight-associated information.
5.4 If you need to make changes to an already booked flight or service, you may do so following the terms and conditions of the specific supplier.
5.5 You are not allowed to authorize a third party to use your account, nor may you assign or transfer your account to another person or entity. You are responsible for maintaining the confidentiality of your account password.
5.6 If any information you provide to us contains personal data about one or more individuals, it is your responsibility to ensure that you have obtained the consent of such individual(s).
- Intellectual Property
The trademark FlygMedpoäng and the FlygMedpoäng logo are marks owned by us. You agree not to use our trademarks, trade names, service marks, logos, or any other proprietary designations without our prior written consent.
- NO WARRANTY
7.1 The Service and Platform are provided "as is" and "as available." We do not guarantee the accuracy, completeness, or usefulness of any information provided in the Service. We do not warrant that your use of the Service will be secure, uninterrupted, safe, always available, error-free, meet your requirements, or that any defects will be corrected.
- LIMITATION OF LIABILITY
8.1 We shall not be liable for any injuries, harm, loss of revenue, actual or anticipated profit, loss of business, contract, goodwill, or reputation, loss of anticipated savings, loss, damage or corruption of data, or any other indirect, incidental, special, or consequential loss or damage of any kind. The exclusion of liability shall apply regardless of whether or not such loss or damage was possible to anticipate and irrespective of whether or not liability would otherwise arise under contract, tort (including negligence), statutory duty, or otherwise.
8.2 Our maximum aggregate and cumulative liability to you shall be limited to 1 000 NOK. We expressly exclude any and all liability to any third party.
- INDEMNIFICATION
9.1 You agree to indemnify, defend, and hold us harmless from and against any and all claims, losses, expenses, or demands of liability, including reasonable attorney's fees and costs, in connection with any claim arising out of your use of the Service or your violation of these Terms.
10. CHANGES TO THE SERVICES FlygMedpoäng may, at any time and without prior notice, make ongoing changes, improvements, and/or terminate your access to all or some of the Services and/or marketplaces in FlygMedpoäng channels, including design and layout, search and presentation logic, and category structure. This also includes changes that may result in ads being moved, deleted, or similar. If you need to keep an ad, we recommend that you take a photocopy/screenshot of the ad and store it elsewhere.
For changes of significant importance, FlygMedpoäng will do its best to provide advance notice of the changes.
12. RIGHT OF WITHDRAWAL
When you purchase courses online, you usually have a 14-day right of withdrawal. However, to enroll in courses on FlygMedpoäng, you must waive your right of withdrawal since the services for course enrollment involve the immediate delivery of the ordered service (the course). This means that you accept that the right of withdrawal expires when the services are deemed delivered. The services are deemed delivered immediately after you have completed the purchase process and received confirmation that you have enrolled in the course. Corresponding rules also apply to additional services you purchase in connection with the course, such as purchasing extra materials. The booking fee when reserving a flight ticket is non-refundable; only taxes and fees paid to the airline are refunded if you cancel the booking.
11.CHOICE OF LAW AND DISPUTES
Norwegian law shall apply to the use of FlygMedPoäng channels and the interpretation of these terms of use.
In case of any disputes between FlygMedpoäng and you as a user, you may bring the dispute before the Consumer Council, which can handle the matter between you and FlygMedpoäng: https://www.konsumentverket.se/
Otherwise, disputes shall be resolved by ordinary Norwegian courts, with the Oslo District Court as the first instance.
